Terms and Conditions

BY REGISTERING FOR THIS SPECIALIZED SERVICE, YOU CONSENT TO THE RECEIPT OF INFORMATIONAL TEXT MESSAGES OR PHONE CALLS ON YOUR MOBILE PHONE FROM NTTA OR ITS SERVICE PROVIDER USING AUTOMATED TECHNOLOGY (INCLUDING PRE-RECORDED VOICE MESSAGES). When opting in for these recurring SMS text messages, message and data rates may apply. You can Reply INFO to 34421 to learn more about the service. You can Reply STOP to 34421. You may dial “9” to opt-out of automated telephone calls. IF YOU OPT-OUT, YOU WILL NO LONGER BE ABLE TO UTILIZE THIS SPECIALIZED SERVICE; HOWEVER, YOU MAY STILL RECEIVE PUBLIC ALERTS PROVIDED PURSUANT TO APPLICABLE LAW.

1. Description of the Service:

North Texas Tollway Authority (“NTTA” or “we”), a political subdivision of the State of Texas, may utilize a specialized service (the “Service) to notify and/or facilitate bi-directional communications with potentially impacted members of the public concerning an actual or potential emergency or other safety-related event (an “Incident”). The Service is built on the Integrated Public Alert & Warning System (“IPAWS”) of the U.S. Federal Emergency Management Department (“FEMA”). However, these Terms and Conditions (“Terms”) apply only to the Service, and do not apply to the operation and use of the IPAWS system independent of the Service.

If you register for the Service, you may receive alerts or other information from NTTA (“NTTA-Issued Alerts”) about the Incident(s) you have registered for, and you also may be able to contact and, in some cases, to communicate with NTTA concerning a given Incident. THE SERVICE IS PROVIDED AS A PUBLIC CONVENIENCE AND SAFETY-ENHANCING MEASURE. THE SERVICE SHOULD NOT BE USED FOR EMERGENCY-RELATED COMMUNICATIONS. FOR ANY EMERGENCY SITUATION, CALL 911. The information provided through the Service supplements, and does not replace, the alerts provided in the normal course through IPAWS. Your use of the Service is voluntary.

2. Communications:

You may select to receive NTTA-Issued Alerts through the Service in the form of text messages or through IVR (Interactive Voice Response) phone calls, which are sent using automated technology. Opt-out methods are described above.

3. Information Collection, Use, and Disclosure

Please see NTTA’s privacy policy https://www.ntta.org/privacy-policy as to NTTA’s practices with respect to handling personal information. In connection with the Service, NTTA and its service provider receive your mobile phone number and location information as well as any other information you provide when you communicate with using the Service.

Access to user location data during the event is restricted to authorized users from NTTA or its service provider. Your location data will be stored for the duration of the Incident (or up to ten days, whichever is longer), after which your personally identifying information (such as your phone number) will be disassociated from the location information in our database. Deidentified location data may be retained for the purpose of after-action reviews and audits.

Your information will be used or disclosed by NTTA and its service provider only for the purposes of providing and improving the Service, for other public safety purposes (including to address the Incident), and as required by law.

4. Disclaimer

While NTTA will attempt to provide accurate and timely alerts and information, NTTA makes no representation or guarantee as to the accuracy, timeliness, or quality of any information provided through the Service. NTTA also makes no representation or guarantee that the Service, or any component of the Service, will always be available or will perform in any particular manner.

5. Prohibited Uses

You may not use the Service other than to communicate with NTTA about the subject of the NTTA-Issued Alert that you receive through the Service. NTTA will not respond to any communications concerning other topics or any communications that are unlawful, harassing, or abusive. In using the Service, you may not impersonate any other person or misrepresent your affiliation with any particular organization. Your use of the Service may be blocked by NTTA if NTTA believes it is likely that (a) you have violated the foregoing (or any other aspect of these Terms) or (b) you are misusing the Service in a disruptive, excessive, or other abusive manner.

6. Limitation of Liability and Governing Law

The Service is provided as a public courtesy, free-of-charge. NTTA disclaims and shall not be responsible for any claims allegedly arising or damages allegedly incurred in connection with use of the Service. To the fullest extent permissible by law, you hereby release and discharge NTTA and its service provider from any and all claims, demands, liabilities, and causes of action, whether known or unknown, against NTTA and/or its service provider arising out of or related to your use of the Service. The foregoing release includes without limitation any direct, special, indirect, incidental, or consequential damages.

These Terms and Conditions shall be governed in accordance with the laws of the state of Texas. Exclusive venue for any disputes related to the Services or these Terms shall be in the state and federal courts located in Plano, Texas.

7. Changes to These Terms and Conditions

NTTA reserves the right to modify these Terms and Conditions from time-to-time on a going-forward basis, in which case NTTA may require your agreement to the updated Terms as a condition of further use of the Service.
